查了半天,翻了翻没怎么看的讲信用证的书,总觉得第一句有歧义。
是(1)Upon the present statement is signed [ within 3 (three) international banking days Party 1 will]
还是(2) [ Upon the present statement is signed within 3 (three) international banking days ] Party 1 will
这里明显是party1向party2付款,所以对于party2来说,(1)还是(2)都可以,但对于party1来说,如果对方要求是(1),并且party1不能担保在3个银行工作日内向对方收款行开出MT700格式的信用证并附上发票,那么party1就可诉被诉违约
另外,好像并没有international banking day这种说法,banking day的计算应以信用证生效所在地的银行工作日计算。
最后,建议你去问对信用证操作有一定实际经验的人,必要的时候可以要求对方对条款不清楚的地方给出解释或改一下措词,避免掉入陷阱
